1. Acceptance of the Terms

By creating an account, starting a free trial, or otherwise accessing or using the Work Games platform ("Service"), you agree to be bound by these Terms of Service ("Terms").

If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not use the Service.

2. Intended Use

The Service is designed as a work management and productivity tool that incorporates gamification mechanics and game-like experiences intended to be used in the context of professional work activities.

You agree to use the Service:

For lawful, legitimate, and good-faith work purposes
In a manner consistent with professional conduct
Without manipulating or misusing game mechanics in ways that undermine the Service or other users

The Service is not intended for gambling, real-money gaming, or non-work-related activities.

3. Accounts and Eligibility

You must be at least 18 years old to create an account.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.

4. Free Trial, Subscriptions, and Billing

Free Trial

Work Games offers a 14-day free trial. At the end of the trial period, you will be charged to your selected payment method. You will not be charged if you cancel before the trial ends.

Paid Plans

Subscriptions are billed on a monthly or yearly basis.
Charges begin immediately after the free trial ends.
Subscriptions are priced per seat.

Seats and Changes

Seats are purchased for the remainder of the current billing cycle.
Removing users from an account does not result in a refund.
Removed seats remain available for reassignment until the end of the billing period.

Payments

Payments are processed through third-party payment processors. All fees are non-refundable unless required by law.

4A. Closed Beta Offer

Work Games may offer a special "Closed Beta" or early access program ("Closed Beta Offer"), under which eligible users may access the Service free of charge for a 60-day free trial, after which Work Games reserves the right to extend or modify the offer at its discretion, subject to the terms outlined in this section.

Eligibility and Conditions

To qualify for and continue participating in the Closed Beta Offer, users must:

Actively use the Service for legitimate work purposes
Provide regular, honest feedback about the product when requested
Report bugs, issues, or unexpected behavior encountered while using the Service
Valid credit card may be required to ensure eligibility, but will not be charged during the Closed Beta period.

Failure to provide reasonable feedback or to participate in good faith may result in removal from the Closed Beta Offer at our discretion.

Duration and End of Offer

The Closed Beta Offer is provided as a 60-day trial period.
The trial period may be extended at Work Games' discretion.
After the trial ends, continued use of the Service requires the purchase of a paid subscription (or free for the Explorer plan, if eligible).

No Guarantee of Continuation

Participation in the Closed Beta Offer does not guarantee:

Continued free access
Feature availability
Data retention beyond standard policies
Future pricing or discounts

Work Games reserves the right to modify or discontinue the Closed Beta Offer at any time. Users already participating will continue to enjoy their extended trial period as long as they keep being eligible, but there is no guarantee of continued free access after the trial ends.

5. License to Use the Service

Subject to these Terms, Work Games grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.

You agree to use the Service with good intentions and not to:

Interfere with the normal operation of the Service
Attempt to gain unauthorized access to systems or data
Use the Service to harm others or the platform

6. User Content and Data

You retain ownership of all work-related data and content you upload to the Service ("User Content").

By using the Service, you grant Work Games a limited license to:

Host, process, and display User Content solely to provide the Service
Collect and analyze usage and performance data in aggregated and anonymized form to improve the Service

Work Games does not claim ownership over your User Content.

7. Acceptable Use

You may not:

Abuse, harass, or harm others
Reverse engineer, decompile, or attempt to extract source code
Exploit bugs or vulnerabilities
Use automated systems to access the Service without permission
Use the Service for unlawful purposes

8. Suspension and Termination

We may suspend or terminate your access to the Service if:

You violate these Terms
Your use poses a security, legal, or operational risk
We are required to do so by law

You may terminate your subscription at any time. Termination does not entitle you to a refund for unused portions of the billing cycle.

9. Disclaimers and Limitation of Liability

Disclaimers

The Service is provided "as is" and "as available." Work Games makes no warranties regarding uninterrupted operation, error-free performance, or fitness for a particular purpose.

Limitation of Liability

To the maximum extent permitted by law, Work Games LLC shall not be liable for indirect, incidental, or consequential damages, including loss of data, profits, or business opportunities.

Our total liability shall not exceed the amount paid by you to Work Games in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email. Continued use of the Service constitutes acceptance of the updated Terms.
